This Dispute Resolution Policy outlines the steps and procedures that all users must follow in the event of a disagreement or conflict.
By using our services, you agree to abide by the following terms:
1. Informal Resolution
Before escalating a dispute, we encourage users to first attempt to resolve the issue through direct, informal communication. We recommend that all parties involved in the dispute engage in a conversation to understand each other’s concerns, and attempt to reach an amicable solution.
Steps for Informal Resolution:
- Step 1: Contact the other party directly through the Gardeners for Hire messaging system or by using the contact information provided on their profile.
- Step 2: Clearly explain your concerns and provide relevant details about the issue.
- Step 3: Work together to find a reasonable solution. If a resolution is reached, document the agreement and ensure both parties are satisfied.
If the dispute is not resolved through direct communication, you may escalate the issue as outlined below.
2. Formal Dispute Resolution Process
If informal resolution fails or is not possible, the following formal steps will be taken to resolve the dispute.

Step 1: Submit a formal dispute claim to Gardeners for Hire through our designated dispute submission form, available on our website. You will be required to provide the following:
- A detailed description of the issue.
- Any supporting documentation or evidence related to the dispute.
- Information about prior attempts to resolve the issue informally (if applicable).
- The outcome or resolution you are seeking.

Step 2: Upon receiving your dispute claim, we will review the matter and notify all parties involved within 5 business days. We may request additional information or clarification from any party involved in the dispute.

Step 3: Gardeners for Hire will conduct a thorough investigation into the dispute. Our team will evaluate the evidence and determine whether any actions are needed. We may facilitate communication between the parties to help reach a mutually acceptable resolution. If necessary, we may intervene and provide recommendations based on the circumstances.

Step 4: After reviewing the dispute, Gardeners for Hire will issue a final decision. This decision may include mediation, changes to the member’s profile or services, account suspension, or other appropriate actions. We will inform all parties involved of our decision within 10 business days of receiving the formal claim.
3. Arbitration Agreement
If the dispute cannot be resolved through informal means or formal intervention by Gardeners for Hire, the parties agree to resolve the dispute through binding arbitration, rather than through court. The arbitration process will be governed by the following terms:
- Arbitrator: A neutral, third-party arbitrator will be selected jointly by both parties. If the parties cannot agree on an arbitrator, Gardeners for Hire will appoint an arbitrator.
- Location and Costs: Arbitration will take place remotely or in a location agreed upon by both parties. Each party will be responsible for their own costs unless otherwise decided by the arbitrator.
- Binding Decision: The decision made by the arbitrator will be final and binding, and it may be enforced in any court with jurisdiction.
4. Exceptions to Arbitration
Arbitration will not be required in the following cases:
- Claims or disputes that may be brought before a small claims court.
- Matters involving claims of intellectual property infringement, where applicable.
- Claims of fraud, or violations of Gardeners for Hire‘s Terms and Conditions.
5. Confidentiality of Dispute Resolution
All parties involved in the dispute resolution process agree to maintain confidentiality regarding the dispute and any sensitive information disclosed during the process. This includes any materials, conversations, or agreements related to the dispute. Confidentiality may be waived only if required by law or for the enforcement of an arbitration award.
6. Dispute Resolution Fee
In the event that arbitration is required, both parties agree to share the cost of arbitration, including the arbitrator’s fee, equally, unless otherwise agreed upon or determined by the arbitrator.
7. Governing Law and Jurisdiction
